‘Bachelor’ Star Asks Court To Drop Charges Related To Fatal Crash
“The Bachelor” star Chris Soules has asked an Iowa court to drop charges related to his allegedly fleeing the scene of a fatal car crash.
In court papers filed on Monday, the 35-year-old former reality star stated that he met the requirements by law following the crash on April 24 involving his truck and the tractor driven by 66-year-old Kenneth Mosher, according to the Hollywood Reporter. “For whatever reason, the charging officer failed to include in the Complaint and Affidavit that Mr. Soules provided his name and accident location to the telecommunication arm of law enforcement prior to his departure,” Soules ‘s attorney Gina Messamer wrote. “Nor did the charging officer mention that Mr. Soules had rendered emergency aid to Mr. Mosher. Ultimately, Mr. Soules’ 911 call establishes probable cause does not exist for the charge against Mr. Soules.”
“Mr. Soules did not depart the scene until he was assured emergency personnel had the situation in hand,” she added. “As a matter of law, the State cannot prove Mr. Soules did not render ‘reasonable assistance.’ Not only did Mr. Soules satisfy the letter of the law, he satisfied the spirit.”
“He gave law enforcement on-the-spot identification and location information and reasonably provided treatment to Mr. Mosher,” she continued. “Because probable cause does not exist to establish Mr. Soules committed the charged offense, the prosecution against him must be dismissed.”
On the 911 tape obtained by People last week, Soules can be heard describing what happened in the accident and saying that the driver of the tractor needs help.
Attorneys argue that Soules stayed on scene until first responders arrived. The reality star was arrested later that day for leaving the scene of the accident.
