Mischa Barton’s ex-boyfriend Adam Spaw has agreed not to distribute an alleged sex tape of the actress, but did not admit to possessing any intimate videos or photos of her.

Barton learned of the sex tape earlier this year and took immediate legal action against ex-boyfriends Spaw and Jon Zacharias, who appears in the alleged tape with “The O.C.” star.

The 31-year-old actress reached a settlement with Spaw in court this week in which he agreed to a five-year restraining order and an agreement to never release the intimate videos or photos, E! News reports. (RELATED: Mischa Barton Opens Up About Her Emotional Abuse After Her Sex Tape Surfaced)

“I am pleased that we were able to block sale or distribution of the explicit images of Ms. Barton that were shopped around earlier this year,” Barton’s attorney Lisa Bloom said in a statement. “After months of litigation, we have reached a settlement that gives us everything we wanted: stay away orders, and a promise not to distribute or post the images, ever. Mischa fought this case for many months and her tenacity led to this victory. I am proud to represent her.”

Spaw and Barton are required to stay “100 or more yards away from each other, their residences, pets, vehicles, and places of employment, and shall have no contact directly or indirectly with each other,” according to the court documents.

There is no news of Burton’s case against Zacharias, who she claims filmed the two of them without her knowledge, however, Spaw is maintaining his innocence when it comes to the tape. The court documents revealed that his signing the agreement was “not an admission by Adam that he possesses or attempted to sell any intimate photos or videos of Mischa Barton.”
