Lawsuit Names NFL Linemen In Sexual Assault Accusation

A woman is accusing Marcell Dareus of sexual assault and giving her a STD, according to a lawsuit filed in Florida, which was first reported by WJXT-TV.

According to the lawsuit, the woman identified as “Jane Doe” says that her and Dareus spent the night in a Houston hotel in April. The next day, she supposedly woke up in pain and unable to remember the night before. Dareus allegedly said to her that she and him had a sexual encounter the night before. Later that week, the woman was found to have herpes after her and Dareus continued to allegedly see each other. She is accusing him of not disclosing he had herpes and having intercourse with her while unconscious.

The attorneys for the woman said “[The] defendant’s negligence and negligence has caused [the] plaintiff to suffer severe physical and mental injuries, including, but not limited to, past and future medical costs, past and future pharmaceutical costs, past and future physical pain and suffering, past and future mental anguish and loss of enjoyment of life.”

Dareus has yet to be charged of any crimes by the Texas government, according to Harris County court records. Dareus is still not under investigation by any police records, as there is no indication that the officials responded to the dates in the lawsuit. No criminal charges have been shown to be pressed against Dareus either.

Another one of the woman’s attorneys said, “There are civil and criminal laws in both Florida and Texas that address circumstances where someone knowingly exposes another to sexually transmitted diseases. As of now, we are not aware that any criminal charges have been filed in this matter. Our focus is on protecting our client’s right to recover damages for the severe physical and emotional harm that’s been caused to her.”

Dareus was traded to the Jaguars halfway through last season. He played in nine games for the Jacksonville Jaguars, and seven for the Buffalo Bills. He recorded 29 total tackles, while also racking up 2 sacks for the team. The Jaguars have high hopes going into this season, as the team went to the AFC Championship game last year and lost to the New England Patriots by a score of 24-20.

The woman is seeking more than $15,000 worth in damages through the lawsuit.
